This Privacy Policy explains Joyest Technologies Inc's. and its affiliates, Joyest Technologies, Inc ("Joyest",the “Company,” “we,”, the“ Services”, “us,” and “our”) collection, usage, disclosure and security of your information, including your personal information, collected or given through our Site
("Site") and our mobile app ("App"), and how we use information in connection with our services offered through the Site and the App (collective). We are committed to treating your personal information with respect and sensitivity
Our Site, App, and Services are not intended for individuals below the age of majority.
We do not obtain personal details intentionally from such people.

Your approval of this privacy

You agree to our collection, storage, use and disclosure of your information as set out in this Privacy Policy by accessing or using the Services. All previous notices and statements about our privacy policies involving the Services are replaced by the provisions of this Privacy Policy. You can not login or use the Services if you do not agree to any clause of this Privacy Policy.

We may collect information which identifies you ("Personal Information") while accessing or using the
Services, and we may also collect information that does not identify you ("Anonymous Information").
For purposes of this Privacy Policy, Anonymous Information shall be regarded

Generally, without telling us who you are, or without sharing any Personal Details with us, you can visit the Site or download the application.

We may ask you to provide some personal details, including your name, email address, mailing address, mobile number and payment account information, to register
with the Services account, use other aspects of the Services or connect with us for customer service or for technical support to the Services.
In addition, if we require you to submit certain forms to tax authorities by law, we may ask
for certain personal details, including but not limited to your taxpayer identification number, from you or our service provider.We can also ask if you would like to receive SMS related to the Services.
You expressly agree to accept text messages on the Services in this number by providing your cell phone number.
Data and message fees from third parties may be applicable.
You may refuse to provide us with some Personal Details, but if you do, certain features of the Services may not be accessible
to you or the output of certain features of the Services may be restricted or may not function at all. Information obtained from Devices.
When you access or use the Services via a computer or mobile device, including but not limited to a desktop computer, laptop, mobile phone, tablet or other electronic device (each 'Device'), we may collect information from your Device, such as the type and manufacturer of your Device,
the version and operating system of your Device, your mobile carrier, your Device ID, your mobile phone number, and the version of your Device, interaction with our Site, App, or Services such as computer browser type, pages visited, average time spent on our Site, App, or Services, IP address.
Furthermore, we can collect information about your location from your mobile device when you access or use the
app when you don't access or use the app when you download the app on your mobile device.
We can use this information to provide you with targeted offers and to notify you of locations nearby, where you can use the Services. By adjusting the settings on your mobile device, you can choose to opt out of collection of localization data at all times. Nevertheless, you may not have certain functionality of the Services available to you or certain features of the Services may be minimal or not at all running.

Cookies and similar technologies

Cookies and Similar Monitoring Technologies collected information.
When you access or use the Services, we can place small data files on your device that give your device random unique numbers so that we can identify your device when using the Services. These can include cookies, pixel tags, other shared local items or similar technologies supported by your browser (collectively, "Cookies"). Sessional cookies could be a temporary cookie that expire, and we can use cookies to recognise your user, monitor and retain your configurations and  preferences, enhance Services, provide you the targeted products and services, and collect and analysis information about your access and use of Services.

Persistent cookies are cookies which typically have a long-term expiration date and remain in your browser until they expire or you delete them manually. In order to better understand usage patterns, we can use persistent cookies to enhance services.
Third-party cookies: we can allow some third party persons to position cookies through services to provide us with an insight into the use of the services and use demographic. placement of cookies on your devices by accessing or using the Services as defined in this Data Protection Policy.

You can monitor how your browser reacts to cookies by modifying your web browser privacy and security settings if you choose not to receive cookies through the Services. Our systems can issue cookies when you enter or use the services unless you set your browser settings to reject all cookies. If all cookies are not set on your browser, it may or may not work. In some of our e-mails for you, we may use 'click-through' URLs connected with Site content or the application. The output of such features may be restricted or not work at all. To help us understand and evaluate interest in issues and the usage of the Services, we track clicking info. Do not track. Do not Monitor ("DNT") is an optional browser configuration which enables you to express your preferences for advertisers and other third parties. We don't use technologies to detect your web browser DNT signals.

Information obtained by Payment Cards

Card Networks and Transaction Tracking. If a credit or debit card (a payment card") is attached to your account, we will
obtain Personal Details from your Payment Card network, including transaction information (e.g., Visa, Mastercard, American Express). By connecting a Payment Card to your account, you authorise: (a) us to share your Payment Card details with third parties, such as the payment processor and your Payment Card Network so that it's informed that you are registered for the services; and (b) Payment Card Networks to 1. track the transactions on your Payment Card to see qualified transactions or determine you earn a reward,  2. share transaction details with us to provide the services to you.

You can opt out of such transaction monitoring on the Payment Card(s) that you have registered by delinking them via the Services or by terminating your Account. To cancel your account and your right to use the Services at any time, for any reason or for no reason, contact Customer Support and immediately discontinue all use of the Services. Please note that if you opt out of transaction tracking, certain features of the Services may not be available to you or the output of certain features of the Services may be restricted or may not function at all.

Under this Privacy Policy or the Terms of Service, notwithstanding anything contrary, we shall only use payment card and transaction information as follows: verifying a qualifying transaction purchasing or return for matching transactions to validate whether you qualify for an offer or statement credit; record the transaction information and subsequently retain and use the data relating to Services ;Providing targeted deals that may be of your interest, performing analytics to enhance and optimise the Services, telling partial merchants where a transaction occurred for a certain merchant as needed or awarding points, for example, sharing your the date and amount of your purchase and the final four digits of your card number, so the merchants can your purchase with their records or confirm if there's a missing or disputed transaction;
Provide aggregated and anonymized information relating specifically to registered Payment Card activities to participating merchants solely for the purpose of allowing participating merchants to assess the effects of their campaign; provide information in order to respond to a request from a government authority or payment agency involved in a transaction with you or a merchant; and facilitate the exchange, use or sharing of information described above and herein by and among us, the Payment Card Networks, applicable Third-Party Service Providers and applicable merchants.  
We may obtain Personal Information from social networks of third parties, subject their respective privacy policies and confidentiality settings. In certain third-party locations such as convenience stores, restaurants and any other
points of interest we can also collect anonymous information like machine identifiers.
Such devices can use wireless, near-field communication (NFC) and low-energy Bluetooth (BLE) lightning technology to send your Device signal to us so that we can alert you through a push message that you are near an area where you can use the Services.offering you other goods, programmes or services that we believe may be of interest to you;

How we use the data

Issuing the promised incentives on the basis of your spending with Joyest Partners;
Offering and enhancing the Site, App and Services, including the development and customization of offers and rewards;
Responding to your requests for our Site, App, and Services; Analyzing the use of our Site, App and Services; alerting you to problems related to device compatibility; providing any administrative notifications or alerts and correspondence related to your use of the Services; For marketing and advertising purposes, including sending you promotional material or exclusive deals on our behalf or on behalf of our marketing
partners and/or their respective affiliates and subsidiaries and other third parties, provided that you have not already opted out of receiving such communications; To satisfy the contracts that we have with you;Conducting market research, project development, product creation, problem-solving and user behaviour analysis; Managing, enhancing and nurturing partnerships with third-party service providers, including distributors, suppliers, affiliates, subsidiaries and business associates; Conduct anonymized usage review and market benchmarking; to comply with all relevant laws and
regulations and to respond to valid requests; for any other reason revealed to you at the time we collect your information and/or with your consent; Regulation of our Terms of Service and as otherwise given in this Privacy Policy; A deal involving a merger, sale, substantially all of our properties, or a corporate reorganisation.

If Joyest or you terminate your account, you accept that for one year following the termination, we shall
be able to maintain your data for audit and commercial invoicing purposes, including your personal and transaction information.
We may be needed to verify your identity in order to allow you to use our Site, App or Services.
To do so, we can use information you provide and search it in the databases of our service providers or via other outlets, either guided or through our service providers. In the event you contact us for assistance with the Site, App or Services we will use your Details to verify your identity. For your convenience, we can use your details to pre-complete the fields on the Services. When you use the application or mobile versions of our Site, we will use device manufacturers, carriers of the OS (operating system) producers to collect the specific (device ID) assigned to that device ("device ID").Device IDs allow software developers, advertisers and others to recognise your device solely for application preferences and other storing data purposes.Push notifications can allow us to use your device ID for direct contacting you.
Furthermore, to track suspicious activities we may use device ids. For example, if we detect that several devices access a single account on an App or Site, as defined by monitoring device IDs accessing the Site or App, then you may be able to contact the user to make sure the user has allowed such access.

Information we process may be transferred, stored and processed in the United States, Canada or
any other country in which Joyest or its affiliates, subsidiaries or service providers operate.
You consent and agree to the transfer, storage and processing of your information in any country by using and
providing information to us through the Sites, Apps and Services for the purpose of providing the Site, app and services. Notice that information collected from our gathering, including your personal data may be transferred, stored, processed in a country where privacy laws may not be as robust as those in your country of residence and citizenship.  
We collect and only exchange personal information, with your permission only, in order to conclude an agreement with you or to comply with Joyest's valid and imperative interest in a way which does not surpass your rights and freedoms.We seek to apply adequate protections to protect the privacy and protection of your personal data and to use it only in compliance with your agreement with us and the policies defined in this Privacy Policy.
We also come into data processing agreements and model clauses with partners wherever possible and necessary.

You should also follow the unsubscribe instructions in the email you are receiving. Please note that some of the Service-related messages we send are important for the proper operation and usage of the Services, and you might not be able to opt out of such messages.

How we  protect your data

In our respective physical installations and in our respective computer systems, databases, and communication networks, we have administrative, technological, and physical protections
in force and expect our Third Party suppliers to be sufficiently configured to protect information within those systems against loss, mismanagement, and alteration. Measures that we use can include storing Personal Information on encrypted servers, transmitting Personal Information using encryption technology, and auditing and updating our data collection and storage
practises.

In order for you to use these Services, our Third-Party Service Providers store and/or process your payment card account information through the Site or application. Our agreements with such third parties require them to provide administrative, technological and physical protections for the safeguarding of the protection and confidentiality of such information. To be clear, we do not store your Payment Card account information, nor do we have power over or responsibility for your Payment Card account information.Unfortunately, it is difficult to ensure 100 per cent safe collection or transmission of information through the Internet or other public communications networks, so no such warrant is guaranteed.You also have a part to play in the security of your personal data.
Please safeguard and do not share your username and password with anyone on your account. We will consider that you have approved these instructions if we receive instructions with your Account login details.In any unsolicited contact we
will never request your password (such as letters, phone calls or email messages).

You consent to promptly inform us of any unauthorised use or infringement of protection in respect of the Services by your Account. In our absolute discretion, we reserve the right to refuse to deliver the Services, terminate your Account, and to remove or edit content.

California residents

Under the "CCPA" and subject to derogations, Californian citizens have certain rights in their data, including: the right to know the kinds of information that we have collected (as described above) and the types of sources we obtained them from. The right to have access to such personal data we have gathered and the right
to delete your data; and the right to opt out of your personal information being sold.As we understand it to be described in the CCPA and its implementing regulations, Joyest does not sell or rent Personal Information to third parties.We collect information
that identifies, relates, defines, refers to or can reasonably be connected with, directly or indirectly to, a specific user or device ('Personal Information'). (Personal Information').You may request information on the categories of personal information (as specified by California law) that we have collected about you; the categories of data collection sources; any business or commercial intent for the collection or sale of personal information; the categories of third parties with whom we exchange personal information, if any; and the particular pieces of personal information that we collect.
Please include that in the Data Subject Request, if you want to get information about our business information.
We will explain whether the data were obtained, revealed or collected and stored internally.
Please note that the types of personal information and sources may not exceed what is set out in this Privacy Policy. In addition, we are not allowed to keep any information about you if it is only used for a one-time transaction which will not be retained in the ordinary course of business.
We are also not needed to re-identify personal information if it is not already stored in that manner, nor is it required to provide you with personal information more than twice in a twelve-month span. You can ask us to delete your personal details via our support email support@joyest.co.

Subject to those exceptions set out below, upon receipt of a verifiable data subject request, we shall remove your personal information from our records and direct all service providers to do so.
Please note that if your personal details are required we will not delete:  Fulfil the transaction which personal information is gathered for; provide the good or service requested or fairly foreseen by you, or otherwise enter into contracts between you and us within the scope of our ongoing business relationship with you; Detecting safety accidents, defending against malicious and misleading activities and taking all measures necessary and reasonable to minimise present and future risk; Internal information technology debug and repair as needed; Conduct internal application production and research and demonstration research; Exercise freedom of speech, ensure another consumer's right to exercise freedom of expression or exercise other rights under law; to comply with California Electronic Communications Privacy Act;    participate in public or peer reviewed public-interest scientific, historical or statistical research which adhere to all applicable ethical and privacy laws, where it may make it impossible to delete this information or, where we have received informed consent, seriously impair the accomplishment of such research;enable internal use alone, based on your relationship with us, which is fairly aligned with your expectations fulfilment of an established legal obligation; Use the personal information otherwise internally, in a legitimate way consistent with the conditions in which the information has been given by you.

Data about children

We do not intentionally search or obtain information from the Services from children. If we are aware of and have obtained information from a consumer who is under 13 (or a higher age level where applicable), we will take action to satisfy our legal requirements in order to delete that information.
